2. Scope of Application

These conditions govern purchases made on www.spaziogallery.it and define the rights, obligations, and operating procedures applicable to online orders. Please read them carefully before completing your purchase.

By placing an order, the customer declares to have read and accepted the conditions applicable at the time of purchase. Mandatory consumer protections provided by applicable law remain unaffected.

Products purchased on the website are intended for the customer's personal use. SPAZIOGALLERY reserves the right to refuse or cancel orders that, due to quantity, frequency, method, or other elements, are incompatible with normal retail purchase or suggest resale purposes.

3. Products, Authenticity, and Availability

SPAZIOGALLERY is a multi-brand retailer of contemporary, premium, and luxury fashion. All products sold on www.spaziogallery.it are new and original, unless otherwise expressly stated on the product page.

SPAZIOGALLERY carefully curates descriptions, images, sizes, and product information. However, colors, textures, proportions, and details may vary slightly depending on the device, screen, settings used by the customer, or photographic rendering.

The availability indicated on the website may vary in real time, also due to omnichannel management between e-commerce and physical boutiques. In case of unexpected unavailability after the order, SPAZIOGALLERY will contact the customer to propose an alternative solution, an order modification, or a refund of any amount paid.

4. Prices, Taxes, and Additional Costs

Prices are expressed in the currency shown at checkout and include VAT where applicable. Any shipping costs, duties, local taxes, fees, or additional costs are indicated before order confirmation, when applicable.

SPAZIOGALLERY reserves the right to correct any obvious errors in price, description, or availability. In case of an obvious error, the order may not be accepted or may be canceled, with a refund of any amount paid by the customer.

5. Promotions, Discount Codes, and Special Initiatives

Promotions, discount codes, commercial campaigns, special conditions, and temporary initiatives are valid within the limits, times, and according to the methods indicated in the relevant communication.

Unless otherwise stated, promotions and discount codes are not cumulative and may be subject to exclusions of brands, categories, items, periods, or countries. SPAZIOGALLERY reserves the right to cancel the use of codes or benefits applied improperly, fraudulently, or contrary to the initiative's conditions.

6. Order, Verification, and Contract Conclusion

The presentation of products on the website constitutes an invitation to purchase. The order sent by the customer via checkout constitutes a purchase proposal for the selected products.

After placing the order, the customer receives an automatic receipt confirmation at the email address provided. This communication confirms that the order has been received, but does not exclude any checks on payment, availability, data accuracy, obvious errors, or possible abnormal use of the service.

SPAZIOGALLERY reserves the right not to accept or to cancel an order, even after receiving the request, in case of product unavailability, obvious error in price or description, payment authorization failure, suspected abuse, fraud, resale purposes, or inability to correctly execute the sale.

In case of order cancellation or inability to fulfill, the customer will be informed and any amount paid will be refunded according to the original payment method and the technical timings of the respective provider.

7. Payments

The customer can use the methods available at checkout, which may include payment cards, digital wallets, PayPal, Shop Pay, Klarna, Scalapay, HeyLight, USDC, and other methods eventually activated on the website.

The availability of individual methods may vary based on country, currency, device, order amount, buyer profile, technical requirements, and payment provider verifications.

Installment payment solutions are managed by their respective partners and are subject to availability, eligibility requirements, approval, and conditions shown before confirmation. SPAZIOGALLERY does not directly provide credit and does not directly approve installment plans.

When available at checkout, the customer can pay in USDC via Shopify Payments. Payment in USDC is subject to the availability of the method, the technical requirements of the wallet used, the supported network, and the conditions of Shopify Payments. Any refunds related to orders paid in USDC are managed according to the procedures provided by Shopify Payments and the conditions applicable to the selected method.

8. Shipping and Delivery

Shipping conditions, costs, free thresholds, estimated times, and in-store pickup methods are indicated on the Shipping page.

Delivery times are estimated and may vary due to causes beyond SPAZIOGALLERY's control, including courier delays, periods of high demand, holidays, customs checks, force majeure events, or incomplete or incorrect delivery data provided by the customer.

The customer is responsible for the accuracy and completeness of the delivery address provided during the order. Any costs or delays resulting from incorrect addresses, unavailability, or subsequent modification requests may affect delivery times and, where applicable, be charged to the customer.

9. In-Store Pickup

Where available and agreed upon with Customer Service, the customer can pick up their online order at SPAZIOGALLERY boutiques in Nocera Inferiore. In-store pickup may require presentation of the order confirmation and a suitable document to verify the identity of the customer or the authorized person.

10. Right of Withdrawal, Returns, and Exchanges

Consumers who purchase online can exercise the right of withdrawal within 14 days of delivery, subject to exceptions provided by law. The operational procedures, article conditions, return costs, size exchange, in-store return, and non-returnable items are indicated on the Returns and Refunds page.

Items must be returned intact, unworn, unwashed, unaltered, complete with tags, seals, accessories, dust bags, and original packaging, where present. Footwear must be returned in its original box, protected by external packaging.

Sale, promotional, or outlet items remain returnable within the limits provided by law, provided they meet the conditions of the return policy. Any items indicated as "final sale" may be excluded from exchanges, store credit, or extended commercial windows, without prejudice to the provisions of applicable law.

SPAZIOGALLERY may provide extended return windows for specific campaigns, holidays, or commercial initiatives, communicated in the relevant conditions.

11. Refunds

Once the return is received or proof of shipment is acquired, and the item's compliance is verified, SPAZIOGALLERY will process the refund to the original payment method, in compliance with the terms provided by applicable law.

Technical re-crediting times may vary depending on the bank, circuit, wallet, or payment provider used. In case of installment payment, any plan update, installment reversal, or partial refund is managed by the payment partner selected at checkout. In case of payment in USDC, the refund is managed according to the procedures provided by Shopify Payments and the conditions applicable to the method.

SPAZIOGALLERY may withhold the refund until the goods are received or until the customer has provided proof of re-shipment, within the limits provided by applicable law.

12. Defective, Incorrect, or Non-Conforming Products

The consumer benefits from the legal guarantee of conformity provided by the Consumer Code. In case of a lack of conformity, the customer can request the remedies provided by applicable law, including restoration of conformity, price reduction, or contract termination in the cases provided.

We invite the customer to check the order upon delivery. In case of an incorrect, damaged, or defective item, it is necessary to promptly contact Customer Service at ecommerce@spaziogallery.it, indicating the order number, description of the problem, and photographic documentation useful for verification.

13. Account, Data, and Security

The customer is responsible for the accuracy of the data entered during purchase and for safeguarding their account credentials. SPAZIOGALLERY is not responsible for delays, delivery errors, or inability to fulfill due to inaccurate or incomplete information provided by the customer.

The processing of personal data is governed by the Privacy Policy and the Cookie Policy published on the website.

14. Intellectual Property and Trademarks

Content, texts, images, layout, graphics, logos, and materials present on www.spaziogallery.it are protected by applicable intellectual and industrial property laws, unless otherwise indicated.

The trademarks of the distributed brands belong to their respective owners and are used solely for the purpose of identifying the marketed products.

15. Liability and Force Majeure

SPAZIOGALLERY is not responsible for delays, disruptions, or non-performance due to force majeure, unforeseen events, courier problems, technical malfunctions not attributable to the seller, temporary unavailability of payment providers, or inaccurate information provided by the customer.

SPAZIOGALLERY's liability remains in the cases provided for by mandatory rules and for the protections recognized to the consumer by applicable law.

16. Applicable Law and Disputes

These conditions are governed by Italian law. For consumers, mandatory protections provided by applicable law and the consumer's forum remain unaffected.

The consumer can access alternative dispute resolution tools provided by applicable law, by contacting the competent ADR bodies, where available.
